If you’ve had a letter from us it’s because we’ve identified that your purchase is of the sort where SDLT is often miscalculated.  Experience tells us that errors are often made on certain types of purchase, particularly probate sales, blocks of flats, mixed commercial/residential properties. If your solicitor hasn’t given you a calculation showing you how the SDLT on your purchase was arrived at or referred you to an independent specialist for advice on SDLT then they have probably given you the figure they obtained from using the online HMRC SDLT calculator.   This is a very blunt tool and does not allow the user to input any specific details meaning you are likely to have overpaid SDLT.

If you’re wary having received a letter “out of the blue”, that’s understandable. Examples

The three examples below illustrate how the rate given by the SDLT calculator is not the best rate you are entitled to apply to your purchase.

Example 1

Freehold Purchase – £2,000,000

Shop & 3 Flats, all units the same size – London

SDLT as per the HMRC online calculator - £89,500

SDLT refund possible – £ 60,000

This refund is not subjective, it turns on fact.  However, you can’t ask the HMRC SDLT calculator how to calculate the SDLT on this purchase but by understanding the SDLT legislation and The Finance Act 2003 we were able to ensure that our clients achieved a refund for the sum they had overpaid plus interest.

Example 2

Freehold purchase - £1,400,000

7 part built houses - Lancashire

SDLT as per the HMRC online calculator - £123,250

SDLT refund possible - £81,250

Again this refund is based solely on facts at the time of your purchase but the SDLT calculator doesn’t allow you to tell it precisely what you’ve purchased, you need to know how to apply the rules so as to obtain a refund.

Freehold Purchase – £460,000

House sold by executors – To be demolished - Kent

SDLT as per the HMRC online calculator - £13,800

SDLT refund possible – £ 13,800
